Q: Can Jeffco Elections respond to the following?
Q1) Will the provisional voting offered (allowed) in the August primary
election be the same (rules, restrictions) as in the November general
election?
A1) We will use the same provisional voting rules and regulations if the
law remains the same. We anticipate that it will, but of course, if the
law changes then so will we.
Q2) What is Colorado's and Jefferson County's rules in case a
Provisional ballot is filed in the wrong precinct?
A2) Colorado's rules concerning a provisional ballot that is voted in
the wrong precinct are very clear. The voter must vote in the correct
precinct. If he or she doesn't, then the ballot is not counted.
Jefferson County has no rules on this because we follow the law.
Q3) The likelihood of provisional ballot disqualification should be
very small if the voter makes sure to file it in the correct precinct, isn't
that right?
3) We cannot anticipate the likelihood that the provisional ballot
will be counted. A voter can vote in the correct precinct, but have
voter eligibility that cannot be determined - not registered, wants to
vote the ballot in the wrong affiliation, is legally challenged at the
polls and will not sign the challenge form, has already had an absentee
ballot assigned but refuses to vote the ballot or lost it, etc.
Q4) How well prepared (training, practice, materials, backup resources
for help) are Jefferson County polling places for significant numbers of
provisional ballots?
A4) Our judges are trained in all aspects of the judge process
including provisional ballots. We always make certain that we have
ample supplies at the polling places.
Best hopes,
