Secretary of State, Donetta Davidson was questioned in their stories.  
 
We have some momentum behind us now, and plans for more visits to offices
of elected officials, media events, etc.  Please come to either our

EFF Wins in Diebold Copyright Abuse Case

San Jose - In a landmark case, a California district court has determined
that Diebold, Inc., a manufacturer of electronic voting machines,
knowingly misrepresented that online commentators, including IndyMedia and
two Swarthmore college students, had infringed the company's copyrights.
This makes the company the first to be held liable for violating section
512(f) of the Digital Millennium Copyright Act (DMCA), which makes it
unlawful to use DMCA takedown threats when the copyright holder knows that
infringement has not actually occured.

The Electronic Frontier Foundation (EFF) and the Center for Internet and
Society Cyberlaw Clinic at Stanford Law School sued on behalf of nonprofit
Internet Service Provider (ISP) Online Policy Group (OPG) and the two
students to prevent Diebold's abusive copyright claims from silencing
public debate about voting.

Boulder election officials rejected Monday a final plea from a local
voting watchdog group to conduct an additional accuracy test of county?s
new $1.7-million voter tabulation machine, saying such a test goes against
state law.

At a press conference outside the Clerk and Recorder?s office, three local
activists from Coloradoans for Voting Integrity, a statewide e-voting
watchdog group, called on county officials to integrate a verifiable
hand-count system into the live election process this November, similar to
those required by both California and Nevada state laws. Currently, the
county follows a state-mandated "logic and accuracy" standard that
requires a sample hand-count of a number of ballots which are then matched
against the machine?s tally, before and after an election, but not during.

California Governor Signs Paper Trail Bill
GREAT news to share! California Governor Arnold Schwarzenegger signed SB
1438, which mandates that there be a voter verified paper record of every
digital ballot cast in California by the next statewide election.

This bill passed unanimously out of every committee and on every floor
vote in the CA Legislature.  But, it was opposed by many groups, including
the county registrars. Despite that opposition, the Governor signed this
bill, which essentially codifies California Secretary of State's security
directives from November 2003 and April 2004, and advances the
implementation of the voter verified paper trail by one election (under
SoS Shelley's orders, California would have had it by November 2006, but
not for the statewide primary).

SB 1438 also prohibits the Secretary of State from certifying paperless
electronic voting systems after January 1, 2005, and prohibits counties
from purchasing such voting systems after January 1, 2006.

As Arnold would say, "It's fantasteeek!".

The 2004 presidential election might not be flawed like the last one was;
it might be even worse. Communities across America are purchasing
electronic voting (e-voting) machines, but the technology has serious
security problems that aren't being addressed. Most of the machines use
"black box" software that hasn't been publicly reviewed for security.
Almost none provide voter-verifiable paper ballots to detect fraud. A
recent analysis by several academic researchers outlines the many and
varied ways that anyone from a technically proficient insider to an
average voter could disrupt an e-voting system to defraud an election.

The response of some of the companies that make e-voting machines has been
even more upsetting. Instead of embracing close technical review and public
interest in its products, one of the three major manufacturers of these
machines has embarked upon a campaign of sending cease-and-desist letters
to those who criticize it. The company first sent one to the academic
researchers and then later sent many to individuals and groups who
republished internal email messages that reveal both the problems with the
systems and employee attempts to cover up those problems.

E-Voting technology is promising, but its benefits should not obscure its
dangers. Without basic auditing checks, these machines dramatically
increase the chances for undetectable election fraud. This archive is a
resource in the fight for accountable elections and responsible voting
technology.

Transparent Elections = Voting Confidence<br>
As we approach this fall?s election, we all want our votes to be counted
as we intended when we cast them. <br>
<br>
But what if voting technology makes independent observation of the voting
process impossible?  What if the processes our election officials use, and
the voting machines or optical scanners upon which our votes are recorded
and tabulated are susceptible to malfunction, or worse, tampering? And
what if back-up systems do not provide an independently auditable manner
of verifying that votes were accurately counted?  How do you do a recount
on a questionable system if you can?t see inside of it, and if there is no
paper back-up?  <br>
<br>
These are the kinds of questions that groups like Coloradoans for Voting
Integrity (www.cfvi.org) have struggled to bring to the forefront of
public discourse, and have driven our actions urging election officials to
adopt voter-verifiable paper ballots and verifiable counting processes
(such as a 1% manual recount of all optically scanned ballots to verify
accurate counts). <br>
<br>
We have tried working through the Colorado Legislature to pass new laws
guaranteeing verifiable elections.  Instead, the CO Secretary of State?s
Office has prevailed in introducing and passing a new law this year that
greatly diminishes accountability over elections in Colorado.  Things have
gotten worse, not better.  <br>
<br>
We have tried appealing to county election officials to provide voters
with a choice of paper ballots, to offer voters an alternative to use of
unauditable and unverifiable voting machines.   Again, the Secretary of
State has resisted such efforts by declaring that such multiple ballots
are not allowed in polling places (while accepting that provisional
ballots are still allowed).  <br>
<br>
<b>What Are Our Options? </b><br>
<br>
We feel we have no choice but to sue the State of Colorado to compel the
administration of this year?s elections upon only verifiable systems, such
as voter verifiable paper ballots, and to demand that optically scanned
ballots undergo a mandatory 1% manual recount to verify accuracy in
counting.    <br>
<br>
We are working with lawyers to file a motion in court to stay the
certification of ballots for this fall, seeking the specific remedy of
mandated use of voter verifiable paper ballots over any other election
technology.  We also seek a manual recount of 1% of all optically scanned
ballots to verify counting accuracy, specifying that discrepancies trigger
automatic hand counts of all precincts involved. Our motion must be filed
immediately in order to halt the certification of existing ballots by
September 10th, and to instead force the state to decertify use of
non-verifiable voting machines until such time as voter-verifiable paper
ballots can be produced by these machines for use in any election.  <br>
<br>
<b>How Can You Help?</b><br>

We are now asking for your urgent financial support of this legal effort. 
We need at least $25,000 to help with legal expenses to include court fees,
bringing in expert computer security experts, and a related media campaign
to educate the public on the need for verifiable elections this fall. 
<br>

Gov. Bill Owens weighed in on a legal battle over new voting policies
Thursday, defending Secretary of State Donetta Davidson for preserving the
integrity of Colorado's elections.<br />

Voting-rights advocates, in response, accused the second-term Republican
of playing partisan politics by trying to limit Coloradans' right to
vote.<br />
<br />
"By inserting himself in this lawsuit, it appears that Bill Owens is
merely throwing his political weight around," said Mark Eddy, spokesman
for Fair Vote Colorado, a nonpartisan voter watchdog group.<br />
<br />
"This is not a partisan issue. We are fighting to ensure that every
eligible Coloradan can cast a ballot and that their vote will count," said
Eddy, who was the spokesman for Democrat Rollie Heath's gubernatorial
campaign against Owens in 2002.<br />
<br />
Owens filed a friend-of-the-court brief supporting Davidson in her legal
battle with Colorado Common Cause. The nonpartisan group sued her last
week over a law requiring identification to vote and two rules making it
tougher to cast provisional ballots.</font>

Paperless electronic voting and the continued use of punch cards in
battleground states have all but overshadowed another election relic that
will once again be rolled out (literally) on Election Day. <br />
<br />
More than 21 million registered voters live in jurisdictions using lever
voting machines, a metal behemoth that has been the mainstay in elections
for many generations.<br />
<br />
While 21 million represents only 13 percent of registered voters, it is
noteworthy. As the use of punch cards has plummeted, the percentage of
voters casting ballots on lever machines will decrease by only 2 percent
this year compared to 2000, according to Election Data Services. <br />
<br />
In at least eight states where they are currently being used, the 715 lb.,
5 feet long, four-and-a-half feet high machines will be retired on November
2 when polls close ? at least in federal elections. </font>

a short visit to the Secretary of State?s office to discover that things
are really far worse than they first appeared.<br />

The Rules Change meeting gave each speaker 5 minutes ? not even enough
time to list the names of the problems.  About 200 letters and e-mails
were submitted regarding the proposed changes.<br />
<br />
The hearing gave the Secretary of State the opportunity to drop another
bomb.  She is going to allow people to vote AFTER Election Day.  This is
outrageous.<br />
<br />
Our September 27 objections and our September 30 supplemental objections
are attached.<br />
<br />
The Colorado election system is out of control.<br />

<font style="FONT-SIZE: 11px">CFVI had a very successful rally on Wed.
Sept. 29th on the Capitol Steps.  Candidates from all the major parties
addressed the crowd, as well as Bob McGrath Director of CFVI and Alan
Gilbert, DU Professor.  Gilbert recalled the people who have lost their
lives in efforts to ensure voting rights, and likened what is happening
now to Jim Crow days. <br />
