Fwd: Affidavit (Blows Lid Off Electronic Voting Integrity) & Whistleblower to SoS OH




As some of you may have read, Bev Harris of BlackBoxVoting.ORG (note the dot org) is saying she's concerned that the story coming out of Florida about the insertion of hidden code may be misinformation.


Remembering that, and noting that the following comes from BlackBoxVoting.COM (dot com), if these allegations are able to be substantiated, here's a whole new problem for us to have to deal with in Boulder County.

This seems like a perfect opportunity to drag out that great quote from the Clerk's Office (signed by a "Tom Halicki") from a letterhead correspondence on 1/20/04 explaining why there are no written materials relating to the decision to purchase the system we got that would be subject to an open records request:


"As to other materials that were developed or used by the Clerk's office to make its recommendation to the commissioners to purchase Hart's Ballot Now system, there really are none. We relied primarily on the presentations given to the advisory committee by the vendors, and in Hart's case, we followed up with visits to the company's offices in Lafayette for further discussions and demonstrations. We do not have any relevant emails or word documents relating that have a bearing on how we came to make this decisions, i.e., there are no documents debating the merits on one company versus another, or whether digital imaging is better than optical scanning, or whether one vendor has a service plan that's better than another. That is not to say we didn't debate those issues. However, we had those discussions informally, face-to-face."

And that's how the decision was made to purchase the $1.5 million system that didn't work properly in the Primary OR the General elections, and wasn't recommended to be used as a primary system in the first place by Orange County, California.


Please let me know if you find any supporting material for the story below. If the allegations are true (e.g., if there really is such an affidavit), I think Boulder County citizens should be informed.

Hart Intercivic and ES&S Up to no Good David Allen

I have come into possession of a pair of letters written by a former Hart-Intercivic technician to the Secretaries of State for Ohio and Texas. These letters detail a "long history of concealing problems" and a willingness to ignore potentially serious problems "largely for the sake of corporate profit".

When I read these letters, I contacted the writer to verify his story and authorship. The technician verified that he was the author and that the letters had been sent, but did not wish to have his name revealed as he had sent the letters privately to the two state Secretaries. He did not object to the details of the letters being revealed as he was concerned about whether the matter had been or would be addressed.

These letters were written the end of July and I held off until now in order to give the relevant states the opportunity to do the right thing and investigate these charges. The writer has never been contacted and I must assume that election officials in Texas and Ohio just don't care.

The tech worked for H-I for over two years and left voluntarily because of what he believed to be "criminal fraud, extreme negligence, and a distinct and troubling pattern of failure to uphold the public trust both in violations of the spirit of its contracts [and] also in concealing problems in an industry which so crucially represents the public interest."

The technician addressed problems in Ohio, which he saw while working for H-I, and problems in Tarrant County, Texas, which is where he went to work after leaving H-I.

The following is a whistleblower report from a former employee of Hart-Intercivic (one of several voting machine companies that serviced OH) and of Tarrant County, Texas (utilizing Hart Intercivic and ES&S), as posted in late September 2004 at David Allen's BlackBoxVoting.COM website.

This whistleblower is concerned with three main problems:

    Fraudulent Acts
    Fraudulent Claims
    Misleading Conduct

Among many serious infractions, this insider reports witnessing the installation of remote control software into electronic voting equipment containing sensitive election information. This report was made, in detail, in July 2004 to both the Secretaries of State of Ohio and Texas. When a satisfactory response was not forthcoming from either official, the whistleblower took his report to the voting integrity community.
