5) US Constitution
Furthermore, I have sworn and signed an oath to the Constitution of the
United States of America for the City of Boulder.
[|PT>] What? Are you a marine? Serving in office? I don't get why you keep
saying this.
For a discussion of the Constitutional right to vote and how electronic
voting systems may in fact be unconstitutional, I would refer you to
the work of Lynn Landes:
http://www.ecotalk.org/VotingMachines-
ConstitutionalIssues&FederalLaw.htm
There is nothing about recommending further use of the current system
that is in any way constructive or helpful for the community of Boulder
County, Colorado. It is in fact a waste of our time and resources to
continue to discuss the system, except to demand a full refund.
[|PT>] Well I was there with you on that - until I FINALLY got a copy of the
dubious contract. Have you read it? Few seem to have. I don't mean the
proposed contract, I mean the one that Mike Harlan prepared with Hart and
then Paul Danish signed.
Have you read any of my stuff about the acceptance testing?
The only way we might be able to return this system is to be successful in a
lawsuit against Hart. I personally think that we could get about $138K back.
$78K for the non-existent support, and $60K for the non-existent voter
outreach.
Do you have any idea of the costs of such a lawsuit? If you don't want to
throw good money after bad, then you shouldn't consider this. It might be a
fine object lesson for Hart and other clerks', but it would take every last
dime we have. I'd rather just dump the thing entirely and start over with
something else.
This isn't some lemon car we bought and can just take back. The entire
contract method was faulty and the fault lies with the county.
Hallo - Do you remember me begging you and Neal to visit with Mike Harlan
before he sewed up this contract? I was a broken record for several weeks.
Did you try to mitigate anything before it happened in this case? No, you
didn't. No one did - except me. Harlan is a champion ass to the nth degree.
He doesn't listen and thinks he's still working in corporate America.
As for credibility, the record courtesy of Google is very clear: the
County Clerk and at least one member of her staff failed to meet basic
standards of professional competence. Their ignorance or intentional
oversight caused the County to purchase a system that was not designed
for and is not suitable for election day use. They, not the citizens
who have consistently tried to stop this train wreck, are the ones who
damaged our elections process in Boulder County.
[|PT>] See this is where you're starting arguments with people in your
corner. You haven't bothered to read our minutes or listen to the
deliberations. It's all about Joe. Pay closer attention and I bet you'll
find others agreeing with you. But then that wouldn't leave any time for Joe
to spin; spin spin ...
Luckily, as a member of the public who is not and has not been employed
by the Clerk's office, I can say this without worry, as it seems
obvious (and now documented) to everyone in the County, with a few
exceptions of folks who seem to all have connections to the Clerk's
office in one form or another (such as the personal or family
employment conflicts that at least two members of the ERC have). It is
no surprise that Paul Tiger would seek to attack my credibility, as he
is unable in his role as proxy for the County Clerk to refute any of
the factual matter that has been presented.
[|PT>] Neal; Paul W; Peter R., Kell, plus many CVV members who I fail to
recall right now did work for the C&R. They are now able to tell fact from
fiction; mistakes from conspiracy; or lack of staffing from lack of
planning.
The Clerk has much to answer for, but mostly the problems that we see are
from her bending over backwards to make sure that all the activists were
pleased. I have no doubts of the accuracy of the November election. You do.
Okay, I'm fine with that.
What I'm not fine with is your notion so publicly stated that I fear for my
job. I don't work for the C&R; I haven't worked there in over a year. When I
did work there I was outspoken and often a pain-in-the-ass. You are
completely aware of this. So are many others.
I'm not anyone's lackey and to your sir I happily say, "Fuck You" for making
such accusations. Few people who know me would believe that I suck up to
government.
I'm sure Paul and I will have the opportunity to discuss this in person
sometime soon. I hope the community will discuss this at length, as
well. We must have open and honest discussion or we will end up with
the "clean whitewash" report of the ERC as the official version of what
happened and how to "fix" our elections with more machinery.
I'm honored that I do not represent him, and I urge everyone to
represent themselves in this crucial matter!
[|PT>] That I support. People should think for themselves. But they should
do their own research and have a clear understanding of the fact pertaining
to what is happening in Boulder county and stop applying what happened in
outer Buxdhudi to Boulder.
Joe doesn't know much about what has occurred in Boulder county because he
doesn't really care. He isn't involved. He doesn't want to know. All the CVV
members who actually learned about what goes on in Boulder; those that have
worked on the elections from the inside - they care. Joe, doesn't. Joe wants
you to think about what Joe tells you to think about.
Don't join the ranks of Joe's Sheeple. Think for yourself.
